fileupload not working in modal window

I have a form with a fileupload element ... when i edit or add a record in modal window this element don't upload anything ... if i use ajax upload works or if i use it without the modal window

... simple uploads have never worked with AJAX. That's an HTML thing, not a Fabrik thing.
